Secretive GOP Poll Shows Plurality of New Mexicans Support Domestic Partnerships

Well, that's when the telephone poll asks if the 500 respondents favor domestic partnerships, like the kind proposed in SB 12. In that case, 47% do versus 42% who don't. I guess the New Mexico GOP didn't like that result, so they had their hired Republican polling firm ask another question -- on gay marriage -- which has nothing to do with the proposed bill. An increased percentage were against it. No surprise there.

However, we really don't know how the poll questions were asked, exactly, or how the poll was administered in terms of demographics and weighting. That's because the Republican polling firm hired by the NM GOP has so far ignored requests to release the complete polling data, questions and cross tabs. All we have is the word of the New Mexico Republican Party in a press release on this, and we all know what that's worth.

A major problem with the NM GOP's disinformation campaign is that SB 12, the domestic partnership bill, doesn't just apply to GLBT folks. It provides for a civil domestic partnership license to be available to all unmarried couples regardless of gender. It is NOT a gay marriage bill. In fact, it says so in no uncertain terms right in the bill.

Bottom line: The poll bought by the State GOP shows most New Mexicans surveyed support domestic partnerships. It also reportedly shows that if gay marriage is the issue, support falls. As Matt at New Mexico FBI writes, "So they found that making a false argument against the bill makes people oppose the legislation. I'm sure that saying that the legislation mandates that people have gay marriages with terrorists would make it seem less popular as well. But that doesn't make it true."

The bill's sponsor agrees:

"The poll is bogus because they are using information from other states that does not apply to New Mexico,” said Senator Cisco McSorley of Albuquerque.

Court Decisions Not Related to Domestic Partnership Laws
We must be very close to winning Senate passage of this bill, given the timing of the bogus poll and the right-wingers who are out and about in the media spreading falsehoods. Like this:

“This domestic partnership bill before the Senate is a threat because it is gay marriage in disguise, but not a very good disguise at that,” Sen. Bill Sharer, R-Farmington, said. “The supreme courts in other states have ruled domestic partnership, like the bill being proposed in New Mexico, is same-sex marriage.”

Not true, according to the ACLU. Court actions on gay marriage in Connecticut and California were based on the unique constitutions of those states, not on any domestic partnership bills. In fact, those are the only two states -- out of nine -- that passed domestic partnership or civil union laws whose top courts eventually ruled that gay marriage was allowed by their state constitutions. Moreover, in two of those states -- Washington and New Jersey -- courts specifically decided their constitutions did NOT require marriage, according to the ACLU.

In other words, domestic partnership legislation and state supreme court actions on gay marriage are unrelated. UNRELATED. Bogus polling. Bogus logic. Bogus arguments. All coming from the conservative part of the spectrum.

The Old Bait and Switch
Sen. Sharer and many other opponents of equal civil liberties under the law like to mix apples and oranges when they're making their arguments. When you can't depend on facts, it can be tempting to rely on misstatements and distortions to try and make your case. And that's exactly what the New Mexico Republic Party and domestic partnership opponents are doing. According to the GOP's own secretive poll, they're losing the argument on domestic partnerships with New Mexicans, so they're doing the old bait and switch. The Bush-Rove tactics continue within the GOP even after the two failed politicos have left the White House and our nation in a shambles.

How about this. Since "domestic partnerships" is deemed "favorable" in the polls and the general public....WHY NOT put this on the ballot as a vote? Heck it looks like domestic partnerships is cool since it is winning by a 47-42 margin

Isn't that what a democracy is all about. Put it to a vote! Just like our arguments regarding the National Popular Vote issue where people are arguing one person-one vote. Should there be a referendum on this issue. Better question is would it pass.

Daniel-I wonder if you would put your civil rights on the ballot to be voted on. Maybe we should do the same thing with African-Americans, Hispanics, Jews and Muslims who live in the USA. Lets have a referendum on whether they get to live under the constitution or some religious sect's rules.

Democracy is NOT about voting on people's civil rights. Thats why we have the constitution to protect the rights of minorities. In fact if the USA followed the constitution as it should there would be no need for any minority to fight for its rights under the law.

Funny how the Repubs found data they didn't want to find on support for DP and then created another question that tries to muddy the waters.

All Dems in the Senate should support DP. There are no good excuses left except bigotry and obeying the dictates of religions that crosses the line in the separation of church and state.

The DP bill is about basic human rights and protecting all families-not merely those that the churches approve of. Many gay couples adopt children that would face horrible futures in state custody. We need to reach out and help them get the legal protections they need.

It is absurd for these bigots to be able to deny civil rights based on religious convictions. That is the mask that is worn here.

People understand the difference. This is why there is a plurality of support.

The Republicans and their party of bigots and all they stand for are failing. The next generation of voters will not support them.

Those Republicans who understand the difference need to stand and be counted. Otherwise, they are going to end up in the dustbin of history.

Over the weekend I emailed every Senator requesting support for the bill with a "yes" vote, I received three or four replies with Sen. Sharer telling me point blank that he would not vote for the bill. He included an article he claimed to have written as an attachment, unfortunately it wasn't coded properly so I couldn't open it but as I replied to him, with a title of "Same Sex Marriage" I wouldn't read it anyway as I was not interested in that and that this bill SB12 had NOTHING to do with marriage, same sex or otherwise. Although Religion was not mentioned I couldn't help but get the impression that Sen. Sharer is just another RW religious bigot using his Bible to hide his bigotry.

I think the citizens are beginning to see that this is an issue about civil rights...our civil right to a civil contract...that is exactly what a "marriage license" is. I am not asking to be married before witnesses in a church. All I want is what our married elected officials have...the right to a civil contract. No more...and definitely no less.
Any legislator who votes against a domestic partnership bill is saying to EVERY citizen(gay, straight, or whatever) who wants to take advantage of the benefits it brings (just like our state government employees)"you are not equal to me and don't have the same civil rights as I do".
We tried that once or twice in our history...how did it work out?!?!

I strongly support SB 12; however, it will take considerable effort to prevent a filibuster by the bill's opponents. I hope the Dems have the backbone to see it through.

Isn't this whole show designed to get Cisco cornered into accepting a DOMA?

1) Bill Sharer runs around, with that Arizona lawyer's hand up his back, saying 'this is gay marriage' for 48 hours.

2) His next move is to make Cisco prove it's not just gay marriage by another name--by welding his Definition of Marriage bill (SB 162) into the DP bill.

3) Cisco can try to corral his Dem votes into fighting off that amendment, but the tactic has already put our pro-equality minority on the defensive.

I'm betting that we can measure the purpose of this show by its results, and that by this time tomorrow we have a DP bill that contains a DOMA being debated on the Senate floor.

Who's taking the other side of that bet? Breakfast at the Frontier next Sunday is the stakes.

Funny how many of the same people in the Senate aim to use the same tactics to try to poison bills by adding some awful, unacceptable provision. DOMA in this case. Attacks on the educational activities of nonprofits in the case of ethics.

We need to keep pointing out to all we know how dishonest and downright creepy the obstructionists are, including the Democratic ones. They all stick together on to try to defeat anything that might disturb the filthy status quo up there.

Funny how many of the same people are against ethics reform but try to pretend they are holy holies taking a moral stand on DP. Give me a break.

We may lose this battle again this time but the beauty of it is that we will win next time or the next. The bigots are on the run and they're dying out only to be replaced by more youthful lawmakers who lack the ignorance and hatred of some of their elders. It's a done deal.

The forces against civil rights may win a battle but they will lose the war sooner rather than later. In the meantime I hope every GLBT family calls every lawmaker who votes against DP and tells them exactly how much damage they are doing. Moral my eye.
